Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the services offered by FM Tech ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By purchasing or using our services, you agree to be bound by these Terms.

1. Services

FMTECH provides web design, development, automation and related digital services. The exact scope, pages, integrations, deliverables, exclusions and acceptance criteria are defined in the written proposal for each project.

Hosting and Domain: Hosting, domain registration or renewal, licenses and other third-party services are included only when the written proposal expressly says so. Ownership, renewal dates and future fees are also governed by that proposal and the corresponding provider.

Delivery Times: The schedule depends on scope, approvals, access and receipt of the materials required from the client. The applicable milestones and estimated dates are those stated in the written proposal; third-party reviews or client delays may change them.

2. Client Responsibilities

The client agrees to provide all necessary content, including but not limited to logo, text for all pages, and images, in a timely manner. FM Tech is not responsible for delays in project completion caused by the client's failure to provide materials.

The client warrants that all materials provided to FM Tech are owned by the client or that the client has the necessary permissions to use them.

3. Payments, Cancellations and Refunds

Unless the written proposal states otherwise, projects are paid 50% to reserve production and 50% after approval for publication. Payment methods are agreed with the client.

Each proposal identifies the payment currency and may use Colombian pesos (COP), United States dollars (USD) or Paraguayan guaraníes (PYG). When a conversion is required, the proposal or payment instruction will identify the applicable reference; displayed equivalents are informative unless expressly agreed in writing.

Cancellations and Refunds: If a project is cancelled, any amount payable or refundable is determined by the written proposal, the work already completed, non-recoverable third-party costs and applicable law. No general refund entitlement or waiver of mandatory consumer rights is implied by this page.

4. Optional Maintenance Plan

The client may opt into maintenance or support when offered. Its currency, price, duration, response conditions, included work and exclusions are defined in the corresponding written proposal.

5. Limitation of Liability

To the extent permitted by applicable law, FMTECH does not guarantee sales, search rankings or uninterrupted operation of third-party platforms and is not responsible for changes, outages or decisions controlled by those providers. Nothing in these Terms excludes obligations or rights that cannot legally be excluded; any project-specific allocation of responsibility is defined in the written proposal.

6. Changes to Terms

These Terms may be updated when FMTECH's services, providers or legal obligations change. The published version applies from its stated update date and does not alter an already signed proposal unless the parties agree in writing or applicable law requires it.
